Delivery & Returns Policy

This Policy sets out Sportsforce Pty Ltd ACN 606 955 417, ABN 73 606 955 417’s policy in respect of delivery and returns, trading as EuroOptic Australia.

Unless the context requires otherwise, terms used in this Policy have the definition provided for such terms in the Terms and Conditions which can be found at www.eurooptic.com.au

Costs of Delivery

  1. The costs of delivery of a Product are payable in addition to the price of the Product. You must pay the costs of delivery of a Product at the time you place an Order or at another time notified by us.

  2. We will use our best endeavors to complete the processing, postage and delivery of your Order within the time-frame specified by us. However, given the nature of deliveries, any delivery times stated by us are estimates only and are non-binding on us.

  3. You are required to pay any duties or taxes which attach to the supply and delivery of your Order, including but not limited to custom duties, at the same time as you pay for the Product or otherwise at the time specified by us.

Delivery and Licenses

  1. You acknowledge and agree that given the nature of the Products, they may not be able to be delivered to your nominated address (such as a PO Box address or private residential address) (“Home Address”), and instead will be made available for collection by you at the address nominated by us (“Collection Address”). This applies to airguns, shotguns, firearms, and any other Products we determine at our discretion.

  2. When you place your Order, we will notify you as soon as possible as to where the Product will be delivered and on what date you must collect it. The information we provide to you is subject to change, and on occasion you understand that the collection date may be later than the estimated delivery time specified by us on the Site.

  3. You warrant at the time of placing your Order you hold all necessary identification, licenses and certificates required by law or any authority (“Licenses”) in order to own the Product in the delivery/collection location.

  4. At the time of delivery/collection of your Order, you must present all Licenses and other information requested by us or our delivery agent. You must also complete any forms required by us or our delivery agent.

  5. You warrant that all information (including Licenses) you provide to us are true and correct and has not been fraudulently obtained. We reserve the right to reject any Licenses that you provide to us if we, at our sole discretion, determine that they are not genuine or have expired. You authorise us to undertake any investigations we consider necessary to determine whether the information you have provided to us is genuine. During investigations you authorise us to disclose your personal information to third parties for the purpose of verifying your information.

  6. If you are unable to comply with the above terms, we reserve the right at our sole discretion to refuse to provide you with the Products you have Ordered, and cancel your Order. No refund will be payable to you, and you must pay the costs of returning the Products Ordered from the place where the Products were delivered to us immediately on demand.

Risk and Title

  1. All fully paid Orders will be shipped by the postage carrier nominated by us. Until an Order is paid for in full, title in the relevant Product remains with us.

  2. If an item you purchase is to be delivered by EuroOptic Australia, the risk in such item will pass to you:

    1. in the case of delivery to a Collection Address - when it is delivered; or

    2. in the case of delivery to your Home Address - if we are unable to deliver the item to the place delivery location for any reason, (for example if no one is present to accept delivery), when we or our carrier first attempt to deliver the item.

  3. If we attempt to deliver your Order to your Home Address and you are not present to accept the delivery, we may in our discretion leave the Products at the nominated delivery address or retain the Products and attempt to re-deliver them at another time (in which case you must pay the costs of storage and re-delivery prior to the Products being re-delivered).

  4. If we deliver your Order to a Collection Address and you do not collect the Order within the time-frame specified by us or our delivery agent, the Order may be returned to us. In that case, you must contact us to arrange for re-delivery and collection (in which case you must pay the costs of return, storage and re-delivery prior to the Products being re-delivered).

Returns

  1. General

    1. If you wish to return a Product in accordance with this clause, you must contact us and complete any forms provided by us

    2. You must comply with all directions given by us in respect of returning a Product (for example, we may request that you return a Product to a Collection Address). You must include in the return your original invoice/receipt of for the Product, the forms required by us, and must ensure it is packaged in a safe and satisfactory manner.

  2. Defects

    1. All defects are dealt with in accordance with the warranties provisions on our Site and as set out in these Terms and Conditions.

    2. In the event you notice a defect in a Product, you must notify us immediately and provide us with all information and evidence of the defect required by us.

  3. Process

    1. If you wish to return a Product in accordance with this clause, you must contact us and complete any forms provided by us.

    2. You must comply with all directions given by us in respect of returning a Product (for example, we may request that you return a Product to a Collection Address). You must include in the return your original invoice/receipt of for the Product, the forms required by us, and must ensure it is packaged in a safe and satisfactory manner.

  4. Cost of return

    1. Certain costs may be incurred by you in returning a Product to us, including postage or freight costs. We are not liable for those return costs (although if we accept that a Product is defective we may reimburse you the costs of return upon receipt of evidence of the costs incurred).

    2. You are solely responsible for the risk in the Products being returned to us. In the event you post a Product back to us and it is not received by us, we are not responsible for providing you with a refund or exchange. As such, we recommend you use registered post and obtain insurance for the Products you are returning.
